Appeals about the brands “Romanov” and “Romanoff”.
On April 27 Intellectual property rights court has appointed examination of thecassational appeal against the court decision which on the claim of the Italian company F.LLI Gancia & CSpA had stopped protecting brands "Romanov», Romanoff, Romanow and Pomanoff in respect of goods of class "alcoholic beverages (except beers).
Earlier the Italian company F.LLI Gancia & CspA had sent the claim to the courtof intellectual property rights to stop the protection of brands. F.LLI Gancia & C. S.p.A acts on the market since 1850 and from 2011 through importer "Rust Incorporated" exports its products toRussia.
The Italian company announced its rights to the trademark Romanoff, the protection of which was approved in a number of countries, and the intent to produce on the Russian market of alcoholic beverages under the nameRomanoff. Their demands the Italian company substantiated confusingly similar to the trademark of the two organizations. Meanwhile, the defendant has not provided with sufficient evidence introducing to the market of the goods under a controversial brand.
The court concluded that the plaintiff is a person who has a real intention to use for civilian purposes trademarkconfusingly similar to the disputed trademarks in respect of similar goods.
Considering the mentioned above Court assumes that the plaintiff is a person who is interested in the early termination of legal protection of the similar trademarks in respect of goods of the 33rd class of the Nice Classification- alcoholic beverages, except beer.
